DRIVING UNDER THE INFLUENCE (DUI)

In Kentucky, the legal limit is .08, which means that if you are found to be driving with a blood alcohol content equal to or over that amount, you will be charged with a Driving Under the Influence (DUI). Yet, one may receive a DUI in Kentucky, depending upon age, for having as little as a .02 blood alcohol content in your system.

HOWEVER, ALCOHOL IS JUST ONE FACTOR IN TODAY'S DUI.

More and more DUI's may entail both legal and illegal substances such as heroin, methamphetamines, suboxone amongst other substances.  The only requirement to be charged in Kentucky is that one be under the influence of something that impairs one's ability to drive.


In determining DUI's, law enforcement oversee various tests called field sobrieties and/or blood, breath, or urines tests to determine whether or not your driving has been impaired.


DUI cases have numerous consequences if convicted including but not limited to loss of license, fines/fees, driving classes, and possible jail time. 


But the impact of a DUI can go beyond what is court required.  You may also face issues maintaining or obtaining employment and/or professional licenses.

POSSESSION OF A CONTROLLED SUBSTANCE

Each state regulates the possession of controlled substances differently.  They also differ in their classifications and penalties.  You should be fully aware that Kentucky not only classifies and recognizes the so called CDS (Controlled Dangerous Substances) such as heroin, marijuana, or cocaine, but also includes their compounds (which are necessary for production purposes.)

The Kentucky Revised Statutes includes five (5) schedules of CDS classifications.  They're are used in order to determine the level of dangers associated with the particular CDS (including the appropriate penalties for possession of that controlled substances.)

-Schedule 1 Drugs- Marks the drugs with the highest abuse potential, without an accepted medical use modus.

-Schedule 2 Drugs- Similar to Schedule 1 but includes one or more strictly restricted and controlled medical use modus.

-Schedule 3 Drugs- Drugs with weaker abuse potential compared to Schedule 1 and 2, with one or more accepted medical uses, as well.

-Schedule 4 Drugs- Contain an even lower abuse potential compared to the Schedule 3, including one or more currently valid medical uses, which is/are accepted.

-Schedule 5 Drugs- Contain a lower abuse potential and more accepted medical uses accordingly.

The ongoing positive aspect with many states today is that they are understanding that possession of controlled substances is indicative of a larger problem, primarily addiction. More and more states are leaning towards treatment for one's addiction rather than incarceration.  This is huge turnaround from just 5 years ago when the majority of drug possessions primarily always were incarcerated.
